Gecko Affiliate Program Agreement

1.Introduction
As an authorized affiliate (“Affiliate”) of Gecko, you agree to comply with all terms and conditions set forth in this Affiliate Program Agreement (“Agreement”). Please read this Agreement carefully before registering and promoting Gecko as an Affiliate.
Your participation in the Affiliate Program is solely for the purpose of legally promoting Gecko’s website, products, or services, and earning commissions from qualified purchases or subscriptions made by customers referred by you.
By registering for the Gecko Affiliate Program (“Program”), you confirm that you have read, understood, and agreed to be bound by this Agreement.
2.Approval or Rejection
Gecko reserves the sole and absolute right to approve or reject any Affiliate application at its discretion. You acknowledge that Gecko may reject your application without providing any reason, and you shall have no legal recourse against such decision.
3.Commissions and Holding Period
- Affiliate commissions are calculated and paid on a monthly basis.
- In order to qualify for a commission, the referred customer account must remain active for a minimum of thirty-seven (37) consecutive days (“Commission Holding Period”).
- Affiliates may not refer themselves or any accounts they directly or indirectly control.
- Commissions are paid only for successfully completed transactions that are not refunded, reversed, or subject to chargebacks.
- Commissions shall be paid in South African Rand (ZAR) or another currency as determined by Gecko, using payment methods designated by Gecko.
4.Affiliate Conduct and Termination
Gecko may suspend or terminate an Affiliate account immediately if the Affiliate engages in any of the following:
- False, misleading, or deceptive advertising
- Spam or unsolicited bulk communications
- Promotion on websites involving illegal activities
- Failure to disclose the affiliate relationship in accordance with applicable laws and regulations, including those enforced by the Advertising Regulatory Board (ARB)
- Violation of Gecko’s intellectual property rights
- Unauthorized use of Gecko trademarks or branding
- Offering unauthorized rebates, incentives, or coupons
- Self-referrals, fraudulent transactions, or suspected affiliate fraud
Gecko reserves the right to terminate any Affiliate account at any time, with or without cause.
5.Affiliate Links and Marketing Materials
Affiliates may use approved text and graphic links on websites, emails, social media, and other lawful channels. All promotional materials must be accurate, transparent, and compliant with this Agreement and South African law.
6.Coupons and Promotions
Affiliates may promote coupons or discounts only with prior written authorization from Gecko. Unauthorized coupon promotion, misleading claims, forced cookie placement, or deceptive deal representations are strictly prohibited.
7.Pay-Per-Click (PPC) Advertising
PPC advertising is strictly prohibited without Gecko’s prior written approval.
8.Limitation of Liability
Gecko shall not be liable for any indirect, incidental, or consequential damages, including loss of revenue or commissions, arising from tracking failures, system errors, or third-party actions.
9.Term and Modification
This Agreement begins upon acceptance into the Program and remains effective until terminated. Gecko may modify this Agreement at any time. Continued participation constitutes acceptance of the modified terms.
10.Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of South African courts.
